Healthy Community Healthy You – DUI – Never Drive Intoxicated

Dr. Megan Johnson McCullough -Driving under the influence (DUI) is when a person drives a vehicle while under the “influence” of drugs and/or alcohol. It is commonly called “drunk driving”. The key is that you must be operating a vehicle, not just being intoxicated anywhere outside your home (in public). This can constitute just turning the key to the car or pressing buttons/gears in the car. Different states have different laws, but even if you are just sitting in the vehicle and touching operating parts, a DUI can be administered.

If an officer suspects someone is driving under the influence, they may pull you over. They may then ask the person to perform a field sobriety test. This test can consist of walking in a straight line, reciting the alphabet backwards, and/or balancing on one foot. Ultimately, the person’s blood alcohol content (BAC) will prove whether the person is intoxicated. The legal limit in all states except for Utah is 0.08%. In Utah, it is 0.05%. The only caveat about these thresholds is that for some people depending on weight, age, and gender, how quickly they reach this limit can vary. Refusing to take the breathalyzer will not get the person out of the possibility of getting a DUI charge. In some states, such as Florida, you can lose your license for refusing. Also in most states, you will likely lose your diving privileges for about one year.

Some states do have harsher legal ramifications than others when it comes to the aftermath of getting a DUI. Most states suspend your license automatically, whereas in other places like Texas, you can drive with a temporary permit. You will have a court date given to you that you must appear at. Some people choose to hire their own lawyer to help the charges be dropped, but if not, the court will appoint legal representation for the person. For a first-time offense in which no one was hurt, most times you are charged with a misdemeanor. This could mean serving up to a one-year sentence in jail, paying fines, performing mandatory community, attending substance abuse classes, and/or having a probation term. In some cases, a breathalyzer must be installed into the person’s car.

After the first DUI, charges can get much worse; not to mention the personal impact this can have on a person’s life. There are several consequences that can result in the after math of a DUI. Without being able to drive, transportation to work can be affected. There can be loss of money to pay the fines, and car insurance rates go up for you. The charges can stay on your record for up to 5 or even 10 years. Charges can be very severe if anyone was harmed because of driving intoxicated.
