NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Vista, California, will
hold a public hearing in the Council Chambers at the Vista Civic Center, 200 Civic Center Drive,
Vista, California, on Tuesday, May 03, 2022 at 6:00 p.m. to receive and consider all evidence
and reports presented at said hearing and/or obtained previously relative to the following matter:

P21-0283 – Two Drive-Through Restaurants – NewMark Merrill Companies
A request for a Special Use Permit, inclusive of a Site Development Plan, to develop two drivethrough restaurants, including parking lot and site improvements on 1.40-acres of vacant land
located at APN 221-011-26-00. This project is exempt under State CEQA Guidelines Section
15332 – In-Fill Development Projects, which is a Class 32 categorical exemption.

NOTE: If you challenge this project in court, you may be limited to raising only those issues you
or someone else raised at the public hearing described in this notice, or in written
correspondence delivered to the City of Vista at, or prior to, the public hearing.

ALL INTERESTED PARTIES ARE INVITED to attend said hearing and express opinions on the
matter outlined above.
