LEGISLATIVE UPDATE: ACTION NEEDED
NO on AB 1776 (Aguiar-Curry) “Cartwright Act: violations.”
AB 1776 is a Cost Driver that would significantly expand California antitrust liability by creating new and untested legal standards that are inconsistent with existing state and federal law. This bill will increase costly litigation, create uncertainty for businesses, discourage innovation and investment, and expose employers to lawsuits over common business practices. AB 1776 also expands liability despite a lack of economic analysis demonstrating that California’s current antitrust laws are failing consumers or businesses.
NO on SB 1075 (Reyes) “Expands bureaucracy to slow down housing constructs”
SB 1075 is a Cost Driver that creates new permitting barriers for commercial and industrial projects in disadvantaged communities and increases opportunities for CEQA litigation. The bill could delay job-creating projects, discourage investment, and erode local tax bases.
NO on AB 2564 (Ward) “Surveillance pricing.”
AB 2564 is a Cost Driver that exposes businesses to potential litigation for offering consumer discounts that do not fit within the bill’s limited allowable discount structures. The bill also creates new disclosure requirementsrelated to discount programs despite existing standards under the California Consumer Privacy Act (CCPA).
NO on AB 2575 (Ortega) “Health care services: artificial intelligence.”
AB 2575 is a Cost Driver that discourages the use of artificial intelligence in health care by requiring disclosures when AI tools are used and imposing unworkable liability provisions on health care entities and developers utilizing AI-enabled tools.
